Survey Blaster Terms of Service
Effective date: 1 October 2026
1. This agreement
These Terms of Service ("Terms") are an agreement between you and Audentia LLC, a Wyoming limited liability company ("Survey Blaster", "we", "us") for use of the Survey Blaster website, apps and services (the "Service"). Our Privacy Policy, Acceptable Use and Anti-Spam Policy and [Data Processing Agreement] form part of these Terms. If they conflict on how personal data is processed, the Data Processing Agreement wins, except on liability.
By creating an account, ticking the box at sign-up or using the Service, you accept these Terms. If you accept on behalf of an organisation, you confirm you have authority to bind it, and "you" means that organisation. If you don't have that authority, you are personally bound.
2. Who can use Survey Blaster
The Service is for business and professional use. You must be at least 18 and able to form a binding contract. If you are a consumer, nothing in these Terms limits rights you have under the consumer law of the country you live in.
3. Accounts and users
- Your account. Give accurate information and keep it up to date. Keep sign-in details secure and tell us at once about any unauthorised use. You are responsible for activity on your account.
- Members. Each member seat is for one named person. Seats may not be shared, but you can reassign a seat when someone leaves.
- Translators and client guests. Depending on your plan, you can invite translators and client guests with limited access. They don't count as members where your plan says so. You are responsible for who you invite, what they can see and what they do.
4. Plans, limits and overages
| Plan | Monthly | Yearly | Members | Completed responses |
|---|---|---|---|---|
| Basic | $29 | $290 | 1 | [3,000] a year |
| Team | $49 | $490 | 5 | [12,000] a year |
| Business | $99 | $990 | [15] | [50,000] a year |
Full plan features and limits are on our Pricing page, which forms part of these Terms. Prices exclude taxes unless stated.
- Completed responses are counted only when a respondent finishes a survey. Screen-outs, quota-full exits and test responses don't count.
- Going over your limit. We will notify you. Your live surveys keep collecting responses, and each completed response beyond your plan's allowance is charged as an overage.
- Overages cost $0.10 per completed response and are charged to your payment method at the end of each month in which they occur. Upgrading usually costs less if you regularly exceed your allowance.
- Upgrades take effect immediately and are charged pro rata. Downgrades take effect at your next renewal. If you exceed the lower plan's limits, features above those limits become read-only; we won't delete your data because of a downgrade.
- Free trials last 14 days. At the end of a trial you must choose a paid plan to keep creating and publishing surveys.
5. Payment and automatic renewal
- Your subscription renews automatically at the end of each monthly or yearly term, at the then-current price, until you cancel. We will show you this before you buy and ask you to agree to it, and we will email a confirmation with how to cancel.
- Annual reminder. We will email a reminder at least [15–30] days before an annual plan renews, with the renewal date, price and how to cancel.
- Payment. You authorize us and our payment processor to charge your payment method for all fees when due.
- Failed payments. We will retry and notify you. If payment is still outstanding after [14] days, your account becomes read-only: surveys close, but you can still view and export your data.
- Price changes. We will give at least 30 days' notice of any price change. It takes effect at your next renewal, and you can cancel before then.
- Taxes. You pay any applicable taxes, such as VAT, except taxes on our income.
6. Cancellation and refunds
- Cancel anytime in your account settings. Cancellation takes effect at the end of your current term, and you keep access until then.
- Refunds. All fees, including monthly and annual plans and overage charges, are non-refundable. We don't give refunds or credits for partial periods, unused responses or unused seats. The only exceptions are refunds the law requires. Because the 14-day free trial lets you try the Service before paying, consumers in the UK and EU are asked at checkout to agree that their subscription starts immediately and to acknowledge that they then lose their statutory right to cancel [counsel to confirm].
7. Your content and data
- You own it. Your surveys, responses, contact lists, reports and other material you put into the Service ("Customer Content") belong to you or your licensors.
- Our licence to use it. You give us a limited, worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display Customer Content only as needed to provide, secure and support the Service and as you instruct. This licence ends when your content is deleted, except for backups, which are purged on schedule.
- No AI training. We will not use Customer Content to train artificial intelligence or machine-learning models.
- Usage data. We may use aggregated, de-identified data about how the Service is used, never survey content or responses, to operate and improve the Service.
- Personal data. For personal data in Customer Content, you are the controller and we are your processor. Our [Data Processing Agreement] applies automatically and covers security, subprocessors, breach notification, international transfers and deletion.
- Feedback. If you send us ideas or suggestions, we may use them freely without paying you.
8. Your responsibilities
You are responsible for Customer Content and how you collect it. In particular, you must:
- have a lawful basis for collecting and using respondents' and contacts' personal data, and get any consents the law requires;
- tell respondents who you are and how you will use their data, for example using the consent step and a link to your privacy notice;
- inform people whose details you import as contacts about your processing, within the time the law requires;
- only collect sensitive data, or data from children, where the law allows, with any required explicit or parental consent, and turn on field encryption for such questions;
- follow our Acceptable Use and Anti-Spam Policy and all laws that apply to you.
9. Sending survey invitations
- Your own mail server. When you send invitations through your own mail server (Team and Business plans), you are the sender in law and are responsible for complying with anti-spam and marketing laws.
- The Survey Blaster sender. When you send through our default sender, you remain responsible for your recipients and your message content. We may set sending limits, throttle or pause sending, and require you to verify your identity to protect deliverability for all customers.
- Rules for every invitation. Send only to people who have agreed to hear from you or whom you may lawfully contact; never to bought, rented or harvested lists. Keep the unsubscribe link, identify yourself, and include your postal address. Full rules are in the Acceptable Use and Anti-Spam Policy.
10. Our intellectual property
We own the Service, including its software, templates, design, documentation and brand. We give you a limited, non-transferable right to use the Service under these Terms during your subscription. You must not copy, resell, reverse engineer or build a competing product from the Service, except where the law allows it.
11. Third-party services
The Service may connect to services we don't control, such as your mail server, websites where you embed surveys, Google Fonts, social networks and sites you redirect respondents to. Your use of them is governed by their terms, and we aren't responsible for them.
12. Suspension
We may suspend all or part of your account immediately if you use the Service for phishing, malware, illegal content or spam, if your use creates a security or legal risk, or if the law requires it. For other breaches, we will give you notice and a reasonable chance to fix the problem first. We will lift a suspension once the issue is resolved.
13. Term, termination and your data
- These Terms apply from when you first use the Service until your subscription ends or is terminated.
- You may cancel at any time (see section 6). We may end these Terms on [30] days' notice, or immediately if you seriously or repeatedly breach them. If we end them without cause, we will refund any prepaid fees for the unused period.
- Export window. After your subscription ends, your account stays read-only for 30 days so you can export your data. We then delete Customer Content within 90 days, and backups are purged within 6 months, unless the law requires us to keep it.
- Sections that by their nature should survive termination, such as payment, ownership, liability and governing law, will survive.
14. Availability and changes to the Service
We work to keep the Service available and secure, but we don't promise uninterrupted service, and self-serve plans don't include a service-level agreement. We'll try to give [7] days' notice of planned maintenance that affects availability. We may improve or change features. If a change materially reduces a core feature of your paid plan, we will tell you, and you may cancel and receive a pro rata refund of prepaid fees. Beta or preview features are provided as is and may change or end.
15. Warranties and disclaimers
We will provide the Service with reasonable skill and care. Apart from that, and to the extent the law allows, the Service is provided "as is" and "as available", without other warranties, express or implied, including of merchantability, fitness for a particular purpose or non-infringement. You are responsible for decisions you make based on survey results.
16. Limitation of liability
To the extent the law allows:
- neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, goodwill or data, even if warned of them;
- each party's total liability arising from these Terms is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
These limits don't apply to your payment obligations, your indemnity under section 17, a breach of section 10, or liability the law doesn't allow us to limit, such as for fraud or death or personal injury caused by negligence.
17. Indemnities
- You will defend and indemnify us against third-party claims, regulatory fines and reasonable costs arising from Customer Content, your breach of the Acceptable Use and Anti-Spam Policy, or your unlawful collection, use or sending of personal data.
- We will defend you against third-party claims that the Service, used as permitted, infringes their intellectual property, and pay any resulting award. [Optional; counsel to confirm.]
18. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules, and the state and federal courts located in Wyoming have exclusive jurisdiction [counsel to confirm; or: disputes will be resolved by arbitration under [RULES]]. This doesn't remove protections you have under the mandatory consumer or data-protection laws of the country where you live. Before starting proceedings, each party will try in good faith to resolve the dispute by contacting the other for [30] days.
19. Changes to these Terms
We may update these Terms. We will email account holders at least 30 days before material changes take effect. For paid plans, changes take effect at your next renewal, and you may cancel before then. Continuing to use the Service after that means you accept the new Terms.
20. General
- Entire agreement. These Terms, with the documents they refer to, are the whole agreement between us about the Service.
- Assignment. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets, and will tell you.
- Force majeure. Neither party is liable for delays caused by events beyond its reasonable control.
- Severability and waiver. If a provision is unenforceable, the rest stays in force. Not enforcing a right doesn't waive it.
- Notices. We send notices to your account email. Send notices to us at [email protected] and 30 N Gould St Ste R, Sheridan, WY 82801, United States.
- Language. If we translate these Terms, the English version prevails.
